When it makes sense to file abroad

A Ukrainian certificate gives your trademark legal protection in Ukraine. If the brand moves into other markets, protecting it there takes a separate registration — through the Madrid System or a national procedure.

What is needed to file an international application

An international application never stands alone — it always rests on a Ukrainian base application or registration. Below is the full list of the documents and data we start from.

  • A Ukrainian base application or certificate

    An international application can only be filed for a sign already filed or registered with UKRNOIVI. If there is no base filing, we start with that — a separate service.

  • The image of the mark

    Exactly the same sign as in the base application. It cannot be changed or reworked at the international stage.

  • The list of goods and services in NICE classes

    After filing, the list can only be narrowed, never widened, so we name every class you may need from the start.

  • The list of countries and a power of attorney

    The countries are named in the application; the power of attorney lets us act on your behalf. Further countries can be added later by a separate request.

How international registration runs

    Audit of the base application

    We check whether the Ukrainian certificate or application works as a base, and run a patent search to establish whether the sign can be registered in the countries you want — without narrowing the list of goods.

  2. 02

    Choosing countries and classes

    We look at where you sell goods or supply services — or plan to — where you manufacture and where the counterfeit risk sits, and draw up the list.

  3. 03

    Calculating the fees

    We compute the WIPO fees for your list: the basic fee, the individual fees of particular countries, and the surcharges for classes beyond three.

  4. 04

    Filing through UKRNOIVI

    We prepare and file the international application. The Ukrainian office certifies that it matches the base filing and forwards it to WIPO.

  5. 05

    Examination in each country

    WIPO records the mark in the International Register, after which every designated country runs its own examination — from 4 to 12 months, depending on the country.

  6. 06

    Protection and monitoring

    You obtain protection in the countries that confirm the registration, for 10 years and renewable. We track the deadlines and any office actions.

Worth knowing in advance

Dependence on the Ukrainian application — the first 5 years

This is the defining feature of the Madrid System, and it is better learned before filing than a year afterwards. For 5 years from the date of international registration, it stays tied to the Ukrainian base application or certificate.

  • If the base application is refused or withdrawn, or the certificate is invalidated, the international registration ceases in every designated country at once.
  • Narrowing the list of goods in Ukraine narrows it in the international registration too.
  • After 5 years the international registration becomes independent: what happens to the Ukrainian certificate no longer affects it.

What international registration costs

There is no single price: the total is made up of the WIPO fees, the UKRNOIVI filing fee and our own charge, and it depends on the list of countries and Nice classes you choose.

International trademark registration: how it works

International trademark registration means obtaining legal protection for your brand outside Ukraine. A Ukrainian certificate for a mark for goods and services is valid only within Ukraine, so protection abroad requires either an international application through the Madrid System or a separate national registration in each country.

The Madrid System is administered by the World Intellectual Property Organization (WIPO) and brings together more than 120 states. The idea is simple: instead of filing a dozen applications in different languages and hiring an attorney in each country, you file one application in one language and pay the fees in one currency — Swiss francs.

The application goes through UKRNOIVI, which certifies that it matches the Ukrainian base application or registration and forwards it to WIPO. WIPO then records the mark in the International Register, and each designated country examines it under its own law and may refuse — which is why an international registration is not "one registration for the whole world".

Protection runs for 10 years from the date of international registration and can be renewed indefinitely. The geography can be extended at any time: new countries are added by a separate request, without going through the whole procedure again.

The Madrid System or filing country by country

The Madrid System is cheaper and faster once several countries are involved: one application, one payment, one term. National filing costs more — each country has its own fee and its own local attorney — but it does not depend on the Ukrainian application and is the route where a country is outside the Madrid Agreement or has registration specifics of its own.

The European Union is a case of its own. A single EUIPO application gives protection in all 27 member states, and it can be filed either through the Madrid System or directly. Which is better depends on whether the same filing also needs countries outside the EU.

In a consultation we do not sell a "package": we cost both routes against your list of countries and show the difference in money and in time. Often the sensible answer is to take most countries through Madrid and one or two nationally.

Registering a trademark abroad, for Ukrainian business

Wellmarks has worked in intellectual property since 2010: more than 5,100 registered trademarks and registrations in 120+ countries. We run international filings through WIPO, EUIPO, USPTO, UKIPO and national offices, and where a country’s law requires a local representative we work through partner attorneys.

The most common mistake we are called in on is registering after the fact: the brand has been selling on a marketplace for a year and someone else has already registered the mark in that country. Recovering the name is possible, but by then it is a dispute — different timescales and different money. International registration belongs in the plan for entering a market, not in the response to the first problem.
